Florida woman charged after giving estranged husband's guns to police

Police arrest ‘armed and dangerous’ Florida woman accused of killing daughter stepfather

A Florida lawmaker is warning a state attorney Monday that it would set a "scary precedent" if he prosecutes a woman who recently was arrested after taking firearms from her estranged husband's home to turn in to police.

As Taylor Irby attempted to leave, Joseph Irby followed her and then rammed the back of her vehicle with the front of his, the report said. Courtney Irby spent six days in jail on charges of armed burglary and grand theft after she brought the guns from her husband's apartment to the Lakeland Police.

Courtney Irby was charged with stealing her ex partner, Joseph Irby's guns from his apartment, a day after he went to jail.

According to an arrest affidavit, the couple go into an argument after a divorce hearing June 14.

But the officer that spoke to Irby reportedly responded: "So, are you telling me you committed an armed burglary?"

Behrens asked if Irby had been given permission to enter the apartment, and she said no. The Herald also notes that the wife had obtained a restraining order against her husband.

Both Courtney and Joseph have since bonded out of the Polk County Jail.

His wife, 32-year-old Courtney Irby, told investigators he had tried to run her over with a vehicle.

Spokesmen for the Lakeland Police Department and the State Attorney's Office didn't immediately return requests for comment on Monday. - A Florida woman wanted by police in connection with the fatal shooting of two family members in Port St. Lucie has been arrested.

Irby had applied for a temporary injunction against her husband, with the pair in the process of a divorce, court records showed.

"Yes, I am, but he wasn't going to turn them in so I am doing it", Irby replied. "I have faith in our state attorney's office that they will do the right thing".

Eskamani filed a bill in the past legislative session seeking to expand authority to remove weapons from those convicted of a domestic violence offense. Terry Henkel said Monday afternoon. Sabin, a former candidate for the Polk County School Board, said she felt compelled to help Irby after hearing about the arrest.
