The Senate could block Trump's national emergency

California Attorney General Xavier Becerra

Meanwhile, in a Fox News interview on Sunday, White House senior policy adviser Stephen Miller insisted that the emergency was real, saying there was an "increasing number of people crossing" and "a huge increase in drug deaths".

Considering that 70% of Republicans support the border wall (albeit not necessarily via declaration of a national emergency), Republican congressmen would be in a tough situation, and it is seemingly unlikely that the majority of Republican senators would vote to override the President's veto. Wallace pointed out that that there were only two previous occasions when a national emergency had been declared for military construction - once by President George H.W. Bush during the first Persian Gulf War and the second time by President George W. Bush immediately after the September 11th terrorist attacks.

Critics of the administration's move, which calls for diverting billions of dollars already appropriated to the Defense Department, have seized on some of Trump's comments as proof that he did not need to declare a national emergency.

It is the final pot of money that White House officials said required a national emergency declaration; the White House generally is barred from moving money from one account to another without congressional approval. Democratic members of Congress are preparing a joint resolution to repeal the national emergency in the coming weeks, and are expecting some Republicans will cross the aisle to pass it. The money lost during the shutdown easily could have gone toward wall construction, but instead only indebted Trump and the American economy, making congress less likely to fund the project.

Sen. Chris Coons, D-Del., told CBS's "Face the Nation" that he believes Congress needs to act to "defend" its powers of the purse. "Answer my question. Can you name one case where a president has asked Congress for money, Congress has refused, and the president has then invoked national powers to get the money anyway?"

Even as he claimed the emergency declaration was necessary to thwart what he claimed are drugs and criminals pouring into the USA across the southern border, he simultaneously admitted, "I didn't need to do this".

"My concern is our government wasn't created to operate by national emergency", Hurd said.

Jordan said on ABC's "This Week" that while he thinks the resolutions will pass, "when the president will veto them, I don't think there's any chance that the veto will be overridden". Brown said, "This is the first kind of emergency we've seen like this that a president has done this".

"Can you name one foreign threat in the world today, outside this country's borders, that now kills more Americans than the threats crossing our southern border?"

Congress never defined a national emergency in the National Emergencies Act of 1976, which has been invoked dozens of times without a single successful legal challenge.

The president announced the declaration in a free-wheeling, 50-minute Rose Garden news conference that included a long preamble about his administration's accomplishments.

"I think we do", she said. However, under our Constitution, built on the principle of separation of powers, a disagreement between the President and Congress about how to spend money does not constitute an emergency authorizing unilateral executive action. Others have used national emergencies to limit business dealings with other countries.

Trump declared the national emergency on Friday and shortly after his announcement, the American Civil Liberties Union tweeted that it would be suing the president.

"We'll get them the school they need".
