Supreme Court blocks Louisiana abortion clinic law

When John Roberts voted to uphold President Obama's Affordable Care Act in a 5-4 ruling that squashed a transparent political maneuver by the conservatives on the Court and their allies in the lower courts, it became clear that the Chief Justice was very concerned about people losing their faith in the Supreme Court's legitimacy. Trump appointees Neil Gorsuch and Brett Kavanaugh joined proven conservatives Clarence Thomas and Samuel Alito in indicating they would have rejected the stay and let the law take effect.

"As a pro-life Catholic, I will always advocate for laws that protect the dignity and sanctity of life". Chief Justice John Roberts has never cast a unilaterally pro-choice vote, and I don't expect him to anytime soon.

"If the supreme court allows this law to stand, blatantly denying its own recent precedent, it throws into disarray the whole system of judicial review", said Katherine Ragsdale, the interim CEO of the National Abortion Federation. Roberts, one must understand, voted to uphold the Texas TRAP law in the original case. He wrote that the Court needs more facts about the impact of the Louisiana law before putting enforcement on hold.

About 10,000 women a year seek abortions in the state and the challengers had shown that if the law were to go into effect, only one physician would be able to provide abortions in the state, he said. While Justice Roberts is a conservative, he's considered an institutionalist and an incrementalist with a keen desire to protect the court's legitimacy. In 2017, the law was struck down by the U.S. District Court in Baton Rouge, La., but that decision was later reversed by the U.S. Court of Appeals for the 5th Circuit in New Orleans. The Supreme Court ruled to block the law, since no health, safety or medical reason for it could be found, just as it had a similar law passed in Texas that it ruled as placing an "undue burden" on women in 2016. That decision, and the subsequent refusal to hear it en banc, is a flawless example of the courts going off on its own to advance a political agenda-in this case, an anti-choice one.

Both actions came on emergency requests: in one, to stop the Louisiana law from being enforced and, in the other, to allow the execution of a Muslim inmate in Alabama that a lower court had blocked. "The abortion lobby's relentless opposition to regulations like these exposes the industry's drive for profits above all else". Had Kavanaugh written that Louisiana "pinky promised to not violate the law", his reasoning would have been no less absurd.

Collins played a pivotal role in securing Kavanaugh's nomination when she said she believed he would respect precedent and leave abortion laws intact. Justice Kavanaugh wrote a dissent arguing that the majority erred in blocking the law, providing more ammunition to critics who say - and have said since Kavanaugh was first nominated to the court - that the newest justice is intent on attacking the landmark Roe v. Wade decision.

There are few high-profile cases on the court's docket this year, seemingly by design, after Kavanaugh's tumultuous confirmation hearings.
