Why Trump can't count on the Supreme Court to kill Obamacare

Republicans Say Little About Obamacare Ruling

U.S. District Judge Reed O'Connor in Fort Worth agreed with a coalition of Republican states led by Texas that the Affordable Care Act, the signature health-care overhaul by President Barack Obama, needed to be eviscerated after Congress past year zeroed out a key provision - the tax penalty for not complying with the requirement to buy insurance.

U.S. District Judge Reed O'Connor in Fort Worth agreed with a coalition of 20 states that a change in tax law a year ago eliminating a penalty for not having health insurance invalidated the entire Obamacare law.

Without the individual mandate, Judge Napolitano said, "There's no constitutional basis for it to stand".

The former president tried to quell any dread that the ruling could ultimately strike down the entirety of his signature health-care law, which is commonly referred to as Obamacare.

Then the White House issued this statement: "We expect this ruling will be appealed to the Supreme Court".

"According to a Milliman report requested by the Mississippi Division of Medicaid, an estimated 400,000 people could be added to the Mississippi Medicaid rolls if we accepted the Obamacare expansion", Bryant wrote in a 2012 op-ed for the Washington Times, citing numbers that have since been revised.

Centene Corp (CNC.N) fell 7.8 percent to $117.5, while Molina Healthcare (MOH.N) slumped 10.1 percent to $118.4.

The S&P 500 Managed Care Index fell 2.3 percent to the lowest since October 29, led by Centene, WellCare, Anthem and Cigna.

The AMA will work with patient and other health stakeholder groups in pursuing an appeal and reversal of this unfortunate decision at the district court level.

Outraged Democrats vowed to appeal a federal judge's ruling that could undo the USA health care law known as Obamacare, saying on Saturday that they will use their new power in Congress to hold Republicans responsible and "expose their lies".

The ACA required that all individuals have health insurance or pay a tax and also included payments worth billions of dollars to health insurers to subsidize insurance for low-income Americans. "We should be expanding access to health insurance, including behavioral health services, rather than stripping coverage from Americans in need". Congress reduced that penalty to zero as part of the tax legislation it passed and President Donald Trump signed in 2017. About 11.8 million people nationwide enrolled in 2018 Obamacare insurance plans. The Texas Attorney General, joined by a consortium of 18 other state attorneys general and a governor, initiated a lawsuit attacking the ACA soon thereafter, arguing that the elimination of the linchpin penalty provision rendered the entire law unconstitutional. The Trump administration declined to defend the mandate, spurring Democratic officials in 16 states to intervene.

"I think it was absolutely the right decision", Judge Napolitano said on FOX Business' "Mornings with Maria" on Monday.

"The ACA has already survived more than 70 unsuccessful repeal attempts and withstood scrutiny in the Supreme Court", he said. "Americans who care about working families must do all they can to prevent this district court ruling from becoming law".

"We've increased choice, we've increased competition, and for the first time in a long time, premiums on the exchanges are going down".

The article also described how, as a result of the decision, the Republican caucus is likely to be split between hardline conservatives who insist that Obamacare should be repealed and pragmatists who don't want to alienate voters who benefit from its provisions.

O'Connor's 55-page ruling, now on hold and subject to appeal, was immediately disparaged by critics on the left and on the right and by law professors on both sides of the dispute. But the judge also held that because the ACA is not financially viable without the mandate, the entire law had to be struck down. "This is insanity in print, and it will not stand up on appeal", tweeted University of Michigan Law School professor Nicholas Bagley, an expert in health law.

Another dimension of the controversial case is the fact that Judge O'Connor is widely perceived as a partisan judge, raising questions about his reasoning for deciding that Obamacare must be overturned.
