Klobuchar criticizes court decision on Affordable Care Act

All eyes would be on Trump's latest confirmed justice, Brett Kavanaugh, whose opinions about the health care law have been fiercely debated on the right.

HealthCare.gov, the government's site for signing up, was taking applications Saturday, the deadline in most states for enrolling for coverage next year, and those benefits will take effect as scheduled January 1. Numerous high-ranking Republican lawmakers have said they did not intend to also strike down popular provisions such as protection for people with pre-existing medical conditions when they repealed the ACA's fines for people who can afford coverage but remain uninsured.

"Today's ruling is an assault on 133 million Americans with preexisting conditions, on the 20 million Americans who rely on the ACA's consumer protections for health care, and on America's faithful progress toward affordable health care for all Americans", California Attorney General Xavier Becerra said in a statement.

"We also look to encourage Washington to recognize this for the sea change that it is and to stand down. It is a proper role for the states".

The GOP's failed effort previous year to repeal the law showed there's no consensus within the party itself. Insurance premiums skyrocketed, and critics blame the Affordable Care Act for out-of-control costs and added bureaucratic red tape. He noted that "Congress stated many times unequivocally-through enacted text signed by the president-that the individual mandate is "essential" to the ACA", and its removal rendered the entire law outside the authority of the constitution. A court injunction of some kind to temporarily forestall the administrative dismantling of the Affordable Care Act pending those appeals seems likely. However, we're not there with O'Connor's ruling yet. It has "no impact to current coverage or coverage in a 2019 plan", Seema Verma, administrator for the Centers for Medicare and Medicaid Services, said on Twitter.

Trump hailed the ruling and called on Congress to act.

"The court must find the individual mandate inseverable from the ACA", he said.

In a separate Obamacare case in 2012, five of the nine Supreme Court justices upheld the law. It was an answer to a lawsuit brought by Republican governors who said that without a penalty, there is no "tax".

Spokespersons for the health care industry, for hospitals and other medical providers, and operators of the state-run health insurance "exchanges" (marketplaces where insurance is available under Obamacare) have complained that there would be utter chaos if Judge O'Connor's ruling would go into effect in practical terms.
