Michael Flynn Lying Defense Ripped by Feds 3 Different Ways

Flynn faces up to six months in prison, but he is expected to spend far less time in jail.

Michael Flynn, the former national security adviser for President Donald Trump, has asked a federal judge for no prison time for lying to the FBI, according to a memo by his defense released Tuesday.

Mueller's office had previously told the court that he should receive little to no jail time due to his "substantial assistance" in the special counsel's Russian Federation probe.

"Even when circumstances later came to light that prompted extensive public debate about the investigation of Gen. Flynn, including revelations that certain FBI officials involved in the January 24 interview of Gen. Flynn were themselves being investigated for misconduct, Gen. Flynn did not back away from accepting responsibility for his actions", Flynn's lawyers wrote. But in a memo this week seeking leniency, they revealed details from the interview that helped stoke an unfounded theory that Flynn's relaxed appearance during the Federal Bureau of Investigation agents' questioning was potential evidence that he did not actually lie, and they blamed the Federal Bureau of Investigation for not informing Flynn ahead of time that lying to agents is illegal. Among the agents who spoke with Flynn was Deputy Assistant Director Peter Strzok, who was dismissed over anti-Trump texts.

The agent's impressions "do not change the fact - as the defendant has admitted in sworn testimony to this District Court - that he was indeed lying, and knowingly made false statements", prosecutors wrote.

In arguing for no prison time, Flynn's lawyers cited his "extraordinary" army service as well as a lifetime of devotion to family, fellow service members and veterans. "That notwithstanding, they concluded he was lying". The White House claims he was sacked for lying to Vice President Mike Pence about the details of his conversations with Kislyak.

"Flynn was so talkative, and had so much time for them, that Strzok wondered if the National Security Adviser did not have more important things to do than have such a relaxed, non-pertinent discussion with them", according to notes from the interview.

In other words, there does not appear to be a formal 302 on file about one of the most critical meetings between the FBI and a suspected Russian agent working side-by-side with the president of the United States who had been under investigation by the FBI since July 2016.

Attorneys for Paul Manafort say they're still deciding whether to dispute allegations that their client lied to investigators and breached his plea agreement with special counsel Robert Mueller.

The special counsel's office also notes that Flynn, who was previously a high-ranking national security official, should have been cognizant of what he was doing. "We have now documented that there were at least 16 Trump operatives who had communication or interaction with Russians or Russian operatives during the course of the campaign, so she doesn't stand out all by herself".

Flynn, however, agreed to be interviewed alone.

President Donald Trump says in a new interview that he is not concerned about being impeached by Democrats, saying, "I think that the people would revolt if that happened".

The defendants, their fortunes sliding in opposite directions, represent starkly different paths in Mueller's investigation - a model cooperator on one end and, prosecutors say, a dishonest and resistant witness on the other.
