Federal Appeals Court rules that a Monkey can not copyright his own selfies

The decision, made by the 9th U.S. Circuit Court of Appeals in San Francisco, upheld a lower-court ruling that previously reached the same conclusion.

Despite the settlement, the court refused to dismiss the monkey selfie suit, saying it wanted to make a legal precedent to avoid any similar cases in the future.

In 2015, the People for the Ethical Treatment of Animals (PETA) attempted to represent as Naruto as a "next friend" and filed a lawsuit against Slater, claiming that the photographer violated Naruto's copyright of the photo. It remains unclear what claims PETA purported to be "settling", since the court was under the impression this lawsuit was about Naruto's claims, and per PETA's motion, Naruto was "not a party to the settlement", nor were Naruto's claims settled therein. The majority nonetheless said the court had jurisdiction to decide the case. "PETA began this case purportedly seeking not only an injunction, but also a judgment declaring Naruto to be the author and copyright owner of the Monkey Selfies with all attendant rights and privileges under law", Smith wrote.

"Puzzlingly, while representing to the world that 'animals are not ours to eat, wear, experiment on, use for entertainment, or abuse in any other way, ' " Bea wrote, "PETA seems to employ Naruto as an unwitting pawn in its ideological goals". As for PETA, the organization's general counsel told the WSJ that the ruling "emphasizes what PETA has argued all along - that [Naruto] is discriminated against simply because he's a nonhuman animal". Instead, the court surmised PETA must have seen "the proverbial writing on the wall at oral argument", known it was going to lose, then tried to save itself from an unfavorable opinion by ending the appeal.

Photographer David Slater has won his legal battle over that monkey selfie.

In fact, the court claimed PETA essentially abandoned Naruto. Indeed, if any such relationship exists, PETA appears to have failed to live up to the title of "friend".

The court has also ruled Slater is entitled to compensation for his legal feels, with the district court now working out how much he should get.

"We conclude that this monkey-and all animals, since they are not human-lacks statutory standing under the Copyright Act", the ruling said. The 9th Circuit didn't address that.
