Jury Deliberations Continue In Martin Shkreli Securities Fraud Trial

"Pharma Bro" Martin Shkreli (SHKREL'-ee) is in the courtroom to be sentenced on a securities fraud conviction.

"I'm not the same person I was", Shkreli said.

Defense attorney Benjamin Brafman described Shkreli as a misunderstood eccentric who used unconventional means to make his defrauded investors even wealthier.

One of those references was by childhood friend Franky Guttman, a comedy editor who worked Fox's "The Last Man on Earth" and the documentary "Free Money". "He's no better than any other fraudster".

"The evidence showed that Martin wanted to achieve success by impressing these impressive people, not by inadvertently losing their money through ill-fated investments and certainly not by stealing from them", Brafman wrote.

"Mr. Shkreli is not a child", federal prosecutor Jacquelyn Kasulis said.

Shkreli also got to speak at the hearing, apologizing to investors and accepting responsibility for his actions, according to CNBC reporter Meg Tirrell.

U.S. District Judge Kiyo Matsumoto (KEE'-yoh maht-soo-MOH'-toh) will decide Friday. Prosecutors said that starting in 2009 Shkreli defrauded hedge fund investors, lying to them about losses, and used Retrophin as his "personal piggy bank", siphoning millions of dollars' worth of assets from the company to cover those losses.

The memo also attacks Shkreli's character, from the months leading up to his arrest to his freakish, cocky behavior at trial last summer.

Brafman says that sometimes he wants to hug Shkreli, and sometimes he wants to punch him in the face.

Shkreli became notorious for raising the price of a life-saving drug by 5,000 per cent and trolling critics online. Afterward, he tweeted that the lawmakers were "imbeciles". She said it was clear he is a "tremendously gifted individual who has the capacity for kindness".

"Being a dick to who?"

Shkreli stopped responding to my letters that continued through December.

Shkreli is expected to be sentenced Friday. The judge said the property would not be seized until Shkreli had a chance to appeal.

The government's memo, by contrast, mentions Shkreli's online harassment of Teen Vogue columnist Lauren Duca in 2018 after she publicly declined to accompany him to President Trump's inauguration.

Matsumoto revoked Shkreli's bail in September, sending him to a Brooklyn jailhouse where he's been ever since.

Things abruptly changed, though, last fall after he jokingly offered his online followers a $5,000 bounty to anyone who could get a lock of Hillary Clinton's hair.

Matsumoto ruled on February 26 that the loss amount from Shkreli's crimes was $10.4 million, and she ordered $7.36 million in forfeitures on Monday.

Separately, Shkreli must forfeit almost $7.4 million, a federal judge in Brooklyn, New York, ruled Monday, which could force him to give up a one-of-a-kind Wu-Tang Clan album.

It's less than half of the 15 years prosecutors were seeking, but it far exceeds the minimum 18 month sentence Shkreli's attorneys were hoping to secure for their client, whose 35th birthday is later this month.

Shkreli has been held in a federal prison in Brooklyn, N.Y., for six months.
