No evidence border patrol agents were attacked

El Paso - Today, FBI El Paso Special Agent in Charge Emmerson Buie is sharing findings to date of the investigation into the death of U.S. Border Patrol Agent Rogelio Martinez on November 19, 2017.

The FBI opened an investigation into a possible assault on a federal officer after Rogelio Martinez and his partner, Stephan Garland, were injured while on patrol in a remote area off Interstate 10 near Van Horn in West Texas the night of November 18.

Both agents were airlifted to the hospital, where Martinez died.

The memo also states that due to his injuries, Garland's ability to recall the events has been impaired. The assertion has been echoed by Texas politicians such as Gov. Greg Abbott, Sen.

The union was quick to say the agents were attacked after the incident.

"Border Patrol Officer killed at Southern Border, another badly hurt", he tweeted.

President Donald Trump used the incident to renew his call for a border wall between the US and Mexico. While the investigators could not solve what happened with Mr. Martinez and Mr. Garland, the F.B.I. said the case would remain open. The culvert's six channels are created to direct water beneath the highway.

In the wake of the mysterious incident, local cops suspected that Martinez and his partner might have been clipped by a tractor trailer as they stood just a few feet from the busy Interstate 10. The second Border Patrol Agent was instructed by Border Patrol radio dispatch to go to his Border Patrol vehicle and activate his emergency lights so that first responders could locate them.

The internal memo and the FBI's update on the investigation - the agency's most detailed public account of the nighttime incident - add another layer of uncertainty to the circumstances surrounding Martinez's death. After an autopsy released Tuesday stated that Martinez died from blunt-force trauma from an undetermined cause, the Federal Bureau of Investigation said it had investigated several theories, but none of the interviews, "locations searched, or evidence collected and analyzed have produced evidence that would support the existence of a scuffle, altercation, or attack", reports the Los Angeles Times.

Melinek stressed that the report contains limited information, and she didn't have access to photos, X-rays and other materials available to the El Paso medical examiner who performed the autopsy.

Sheriff Oscar Carrillo of Culberson County, where the two officers were injured, was on scene that night. As a result of the exhaustive investigation, several suspects in Portales, N.M., were charged with alien smuggling, but none were found to be connected to the death of the 36-year-old agent.

Monday, an autopsy report concluded that Martinez died from blunt-force trauma to the head. "The dispatcher also recorded in a Border Patrol log, "[He] thinks they (both agents) ran into a culvert". Martinez's partner, Stephen Garland, survived.

Martinez was found at the bottom of a culvert and died of his injuries the next day.

Martinez's fiancée, Angela Ochoa, and his family have said they don't understand how the agent suffered such severe injuries.

A Customs and Border Protection spokesperson declined to comment on the case.
