Judge will decide fate in Michelle Carter trial

Attorneys for Carter, who was 18 at the time of the texts, had tried to fend off the charges, saying her texts to 17-year-old Conrad Roy were protected speech under the First Amendment. Roy was found dead of carbon monoxide poisoning in his pickup truck in Fairhaven.

"The theme of those text messages can be summed up in the phrase used by the defendant four times between July 11 and July 12, 2014: 'You just [have] to do it, '" the state's court said in a ruling a year ago.

But Carter's defence lawyer Joseph Cataldo said Mr Roy had already been contemplating suicide, even researching online for possible ways to kill himself.

The trial of a teen girl accused of involuntary manslaughter, for allegedly encouraging her boyfriend to attempt suicide, is set to begin Tuesday.

Carter has been charged with involuntary manslaughter and let go of the right to a jury trial. She added that he always seemed to have an excuse to not do it and scolded him for not going through with it.

An acquaintance of the Plainville woman accused of encouraging her boyfriend's suicide said that woman admitted his death was her fault-and that she could have prevented it. They also showed that the two had a phone conversation, as well, when she told Roy to get back into his vehicle after he began to feel the effects of the Carbon Monoxide.

Legal experts said waiving the jury trial works to her benefit, because the judge may not be as swayed by emotion as a jury may be.

"Michelle Carter was 30 miles away [at the time of the suicide]", Cataldo said. The day before, authorities say, Carter had urged him to go through with his plan to commit suicide.

Prosecutors showed texts from Carter to Eithier describing how her boyfriend suffered from depression, and told her she was anxious he wasn't picking up. Their relationship prospered over text message and through phone calls. She is facing up to 20 years in prison.

According to the police reports, which was made after the officials arrested the main suspect, Michelle Carter, who was allegedly being the reason to get his boyfriend killed, and the name of Carter's boyfriend was Conrad Roy III.

Flynn said that Carter even asked one of the Conrad's sisters if she could have some of his ashes after learning he had been cremated.

It was Carter who urged him to get help, Cataldo said. "All you have to do is turn the generator on and you will be free and happy", she reportedly wrote.

In Massachusetts assisting someone to commit suicide is not considered a crime.

She said Carter and Roy did not see each other very often, and told the court she also received texts from Carter about Roy's suicide.

Prosecutors say Carter sent text messages to Boardman saying, "I could have stopped him but I told him to get back in the vehicle".

If the prosecution is successful, however, they could secure up to a 20-year sentence, putting the 20-year-old Ms Carter behind bars until age 40.

"The time is right and you're ready... just do it babe".

In opening statements Tuesday, the prosecution described Carter as a high schooler without many friends who wanted the sympathy and attention of being a grieving girlfriend. "This is a suicide case", he said, "not a homicide".

Under cross-examination she acknowledged there was tension between her son and his father, from whom she was divorced.
