Tyra Banks Sued for "Humiliation" of Child on Am

ABC Freeform 2017 Upfront

A woman who auditioned to be on the new season of 'America's Got Talent' has filed a lawsuit against the show's production company and accused Tyra Banks of abusing her daughter. Jane Doe and her husband John Doe auditioned for AGT and performed a number of songs, including one she wrote about her daughter. In one moment, she alleges, Tyra Banks "physically manipulated" Mary by shaking her and pulling on her hair.

The complaint then accuses agents working for Banks and Marathon productions of instructing "Mary" to "act embarrassed and annoyed by her parents" performance" in front of an "active camera'.

In addition to this, the lawsuit alleges that Banks herself "verbally abused" Mary by making fun of her parents and their song, as well as implying that her conception was an accident, all while the cameras rolled.

Most people who appear on such shows normally sign waivers acknowledging the very real possibility of public humiliation, but the suit argues that Mary, who is a minor, entered into a contract with the production company without her parent's consent.

As Deadline points out, a reality television filming really can be a pretty cutthroat environment, and "those who want to be on a reality competition show need to know what they're getting into". "Mary did not stop Banks' conduct because Mary was fearful". "As a result of her negative experience from "AGT" and Defendant's" abusive treatment, Mary was traumatized and became deeply depressed". They refused to completely edit Jane and her husband's performance, maintaining they will "exploit all footages" despite not airing it in its entirety.

Tyra Banks has been accused of humiliating a girl on America's Next Top Model. Jane says that she and her husband were also humiliated by the audience and judges.

According to the suit, the plaintiffs later asked that "America's Got Talent" not televise or publish any footage of their performance and the child's reaction, for fear of causing further emotional distress. They are seeking an unspecified amount of damages.

Marathon, NBC and representatives for Banks did not immediately respond to a request for comment.
