Sen. Claire McCaskill to vote no on Neil Gorsuch, cloture

Claire McCaskill announced she plans to vote against President Donald Trump's Supreme Court nominee Neil Gorsuch.

"Senate Democrats agreed with that assessment back in 2006, when the chamber unanimously confirmed him to his current post" on the U.S. Court of Appeals in Denver, the Texas Republican said in an op-ed piece on CNN. The Senate's Republicans would need eight Democrats to vote with them in order to prevent the filibuster, a parliamentary maneuver that would make it hard for Gorsuch's nomination to get an up or down vote.

If Senate Democrats filibuster Gorsuch's nomination, McConnell would need to invoke cloture.

Senate Minority Leader Chuck Schumer (D-NY) said last week that he would filibuster Gorsuch's nomination and asked other Democrats to do the same. Manchin said in a statement, "I hold no illusions that I will agree with every decision Judge Gorsuch may issue in the future, but I have not found any reasons why this jurist should not be a Supreme Court Justice".

Most Democrats have said they would support blocking a confirmation vote using a procedural hurdle called a filibuster that requires 60 votes to allow a confirmation vote, although some want to avoid such a move.

The problem for Democrats who make this argument is that filibustering a Supreme Court nominee and taking a cloture vote is far from "traditional" in Supreme Court nominations.

Friday Sen. Claire McKaskill (D-MO) said she will try to block the confirmation.

Until now, McCaskill said she had been undecided on how she would vote, which is scheduled for next week.

With McCaskill's declaration, there are now at least 36 Democrats supporting the filibuster, based on an Associated Press count earlier Friday of at least 35.

If the filibuster is beaten, the confirmation vote itself would require a simple majority.

"And once I get those answers from his past decisions it will give me a pretty good indication how he's going to perform on the court, and then I will either vote for him or against him".

McCaskill is up for re-election next year in a state Trump won in the 2016 presidential election.

Sen. Joe Donnelly (Indiana) - Trump also won Indiana a year ago, making Donnelly another red-state Democrat that Republicans are targeting. Whether it is a freezing truck driver or an autistic child, he has shown a stunning lack of humanity.

McCaskill has previously expressed concern about the threat of a liberal primary challenger in 2018.

When Schumer met with Trump and other senators in January to discuss the Supreme Court, he said he told Trump that "we couldn't support anybody on that list". Surely, this requirement means consent (or denial) by the entire Senate, not by a Senate committee or by a single member of the Senate (such as the majority leader).

"Because the organization is not required to disclose the identities of its donors, the American people have no idea who is so aggressively advocating for your confirmation", the letter says.

Three of the senators holding those seats - Michael Bennet of Colorado, Joe Donnelly of IN, and Jon Tester of Montana - have yet to publicly announce whether they will filibuster Gorsuch's nomination or oppose his confirmation, even as many of their Democratic colleagues have committed to doing both.
