Welcoming the Union government's stand to support abolition of "triple talaq" and polygamy, the Muslim Satyashodhak Mandal - a prominent Muslim reformist organisation in Maharashtra - has appealed to PM Narendra Modi to take steps to implement the Uniform Civil Code.

"The fundamental question for determination by this court is whether, in a secular democracy, religion can be a reason to deny equal status and dignity available to women under the Constitution of India", it said. The sanctity of triple talaq is completely misplaced in a secular country and is unfair, discriminatory and unreasonable.

Chairman of State Minorities Commission that serves Andhra Pradesh and Telangana, Abid Rasool Khan, who had come out openly against the triple talaq issue, on Friday said he would implead in the ongoing case before the Supreme Court to explain the "happenings" in the community so as to protect the interest of Muslim women. The center's comments are in response to the court's call for a wider debate after a Muslim woman from Kolkata challenged her divorce over the phone saying it violated her fundamental rights. As regards divorce laws, majority Muslim countries accept that a Muslim man can not divorce his wife without first obtaining permission from a religious court or Arbitration Council and express consent of the wife from whom he seeks divorce.

According to a report by NDTV, the centre today said: "gender equality and the dignity of women are not negotiable" and told judges that "even theocratic states have undergone reforms in this area of law" which reinforces that these practices can not be considered an integral part of practice of Islam.

"The fact that Muslim countries where Islam is the state religion have undergone extensive reform goes to establish that the practice in question can not be regarded as integral to the practice of Islam or essential religious practices", the affidavit said. "The practice is not prevalent in other Muslim countries where they have more equality", she said.

"Personal laws can not be challenged as being violative of Part III of the Constitution".

"Triple talaq" is becoming a menace for married Muslim women. AIMPLB for example argues that banning polygamy and triple talaq will mean many women will stay spinsters as they outnumber men (no they don't) and will force husbands to get rid of their wives by murdering them. "Dignity of women is non negotiable. there can not be compromise on this", the affidavit said. There can be no progress without gender equality and justice.
